Under the McKinney-Vento Act, a student is considered homeless if they lack a fixed, regular, and adequate nighttime residence. This includes children and youth who are:
- Living in shelters, motels, hotels, or campgrounds due to the lack of alternative adequate accommodations
- Sharing housing with others due to loss of housing, economic hardship, or similar reasons
- Living in cars, parks, public spaces, abandoned buildings, substandard housing, bus or train stations, or similar settings
- Awaiting foster care placement
